Extended Rights Under Minnesota’s Child Victims Act

Minnesota law provides special protections for survivors of childhood sexual abuse. The Minnesota “Child Victims Act” dramatically extends the time to file civil claims for abuse that occurred when you were under 18. In fact, for most childhood abuse claims, you can sue at any time – there is no statute of limitations until you reach age 24. This means, even if decades have passed, you may still be able to hold your abuser (and those responsible) accountable.

  • Who is liable: You can sue the individual who abused you and also entities that were negligent (such as schools, religious organizations, or employers). Minnesota law explicitly allows actions against anyone “who was a cause of the plaintiff’s damages” by committing the abuse or by negligence. Under the Child Victims Act, even lawsuits against institutions must usually be brought by the time you turn 24, though the individual abuser can often be sued anytime before then.
  • Common abusers: These cases often involve authority figures or caretakers: clergy members abusing altar boys/girls, teachers or coaches abusing students, counselors exploiting clients, relatives or family friends abusing children, or Scout leaders and camp counselors who molested youth. Sexual exploitation cases (trafficking or prostitution of minors) may also fall under this law.
  • Damages: Survivors can recover damages for the physical and psychological harm done as a child, including therapy costs, lost earning capacity (if abuse affected education or career), and pain and suffering. Minnesota law provides that the compensation awarded is “fair and just” for all damages suffered, and courts recognize the severe impact of child sexual abuse on victims.
